The History of Divorce in the US
Millions of Americans have gone through the very personal experience of divorce. 10% of American adults have dealt with broken marriages. The most recently reported dissolution rate for the United States is 3.6 per thousand; which is over 900,000 per year. There are 9.2% of households in the United States that are headed by a single mother, and 1.9% are run by single father.
Ending a marriage has only been an option for Americans for a short period of the nation's history. The early American settlers brought with them the English laws in which marriages could only be dissolved by legislative action and then only if one partner could prove a serious fault with the other. A few of the reasons for traditionally ending a marriage would include adultery, desertion, habitual drunkenness, impotence , and cruel and inhumane treatment. States have wanted ending a marriage to be hard so they enforced mandatory proof of dissertations on court.
In addition, the partner suing to end the marriage couldn't personally be guilty of any grounds for dissolution. The decree may not be granted if he or she contributed to the break-up, conspired in the break-up, or had forgiven such behavior previously. After a divorce occurred, the husband usually was given custody of minor children which added to the reluctance of many women to pursue a divorce.
Society in the 1800s didn't really have a place for ex-wives. Even naming them was rather difficult for a while. Among the middle and upper classes, a married woman was always referred to by her husband's name (ie Mrs John Smith), retaining it even as a widow until she remarried. A woman whose marriage had ended could never resume “Miss” or her maiden name. Moreover, she had to change her name from "Mrs. John Smith," to avoid having to face another woman with the same name in the same social group if her ex-husband, Mr. Smith, took another wife. As a compromise it was agreed that a woman would use Mrs. "her maiden surname" then "her married surname", so if a woman named Betty Jones married a man named John Smith, she would then be called Mrs. Jones Smith after her marriage.
Gradually, Americans came to believe that the traditional ways of ending marriage were inhumane and unproductive. Nevada was one of the first locations offering easy decrees to end marriages; in the early twentieth century one need only be resident in the state for six weeks before a decree was possible. This became a wholesale industry catering to people from eastern states like New York, Pennsylvania, and Massachusetts where divorces were much more severely restricted.
No fault divorce has been around since the mid-twentieth century. Roles for women were changing in addition. As better jobs became available to women, it was becoming more practical for single women to support themselves and their children. Also, people's feelings concerning ending a marriage were changing. In previous times, a divorced woman was looked upon with a lot of suspicion and children coming from a "broken home" felt ridiculed by their peers. Gradually, these attitudes eroded as single-parent homes or households with unmarried parents became common. 28% of kids in America live with only one parent.
Although divorce remains a painful and difficult process for everyone involved, much has changed in the last 200 years, which makes divorce a more viable option for many Americans. The process of terminating a marriage is still lengthy and complex, however, there is no longer a need for detectives, dealing with the court system, or automatic loss of custody for females.
